Terms of Sale

These terms of sale govern sales concluded on sweet-houses.com between ASSEMAT ELECTROMENAGER and any consumer. They comply with the French Consumer Code and European regulations.

1. Introduction

Welcome to sweet-houses.com, the online store of ASSEMAT ÉLECTROMÉNAGER, an independent store and member of the national PRO&Cie network. These terms of sale frame the relationship between the store and its customers for any purchase made online: from order to delivery, including payment, withdrawal and warranties. We have written them as clearly as possible, article by article, so that everyone knows exactly what to expect before ordering. By confirming an order, the Customer acknowledges having read and accepted them. We invite you to read them carefully and keep a copy.

2. Subject and seller

These terms of sale (the "Terms") apply, without restriction or reservation, to all sales concluded remotely on sweet-houses.com between ASSEMAT ELECTROMENAGER (the "Seller") and any consumer or non-professional buyer (the "Customer"). The Seller is ASSEMAT ELECTROMENAGER, a French simplified joint-stock company (SAS) with share capital of €3,000, registered with the Castres Trade and Companies Register under SIREN 941 788 077 (head office SIRET: 941 788 077 00019; NAF code 9522Z), intra-Community VAT number FR41941788077, registered office at 14 Rue de Gramentès, 81200 Mazamet, France. Chairman and publication director: Robin ASSEMAT. An independent store, member of the national PRO&Cie network. Sales made in store are not governed by these Terms, as the terms of sale, service and warranty differ. The Terms are available at any time on the site and prevail over any earlier version. ASSEMAT ELECTROMENAGER reserves the right to amend them at any time; the applicable Terms are those in force on the day of the order.

3. Order

The products presented on the site are sold new. The Customer places their order according to the process in force on the site and confirms the detailed summary (products, total price, delivery costs) before validating. The order is registered when the Customer accepts these Terms by ticking the box provided and validates their order (Article 1127-2 of the French Civil Code); this validation forms a distance sales contract. The Customer provides all information needed for delivery (full address, floor, access code, contact phone for scheduling large-appliance delivery) and checks the accuracy of their order, any error to be reported immediately. ASSEMAT ELECTROMENAGER reserves the right to refuse or cancel any order in the event of a prior payment dispute, missing information needed for delivery, product unavailability, or non-receipt of any requested supporting documents; the Customer is then informed in writing.

4. Prices and WEEE eco-contribution

Prices are shown in euros, all taxes included (incl. VAT and WEEE eco-contribution), excluding delivery costs. The WEEE eco-contribution is shown separately on the product page, in the basket and on the invoice. Delivery costs are shown before payment is confirmed. ASSEMAT ELECTROMENAGER reserves the right to change its prices at any time; products are invoiced on the basis of the rate in force when the order is validated. These prices apply to distance selling and cannot be claimed in store (and vice versa).

5. Availability

Offers and prices are valid as long as they are visible on the site, subject to available stock; an availability indication is given at the time of order. As a retailer, ASSEMAT ELECTROMENAGER reserves the right to refuse orders for the same product in large quantities, from 3 identical items. In the event of permanent unavailability, the Customer is refunded for the missing items as soon as possible and within 30 days at the latest; a replacement item of equivalent quality and price may be offered. In the event of temporary unavailability, the Customer is informed of the new availability date and may maintain or cancel their order.

6. Payment

Payment is made when the order is placed via the secure Shopify checkout: bank card (CB, Visa, Mastercard, American Express), Apple Pay, Shop Pay, PayPal and, subject to eligibility, instalment payment via Klarna. No account creation is required (guest purchase is possible). The sale becomes final only after acceptance of the order and collection of the full price.

7. Delivery

Products are delivered in mainland France. Parcels under 30 kg: home delivery for €4.90, free from €99.90 of purchase. Parcels over 30 kg (large appliances, garden furniture, lawnmowers, etc.), delivered by a specialist carrier with an appointment: home delivery €39.90 without installation or €49.90 with installation, regardless of the order amount. The amount is shown before payment is confirmed. Lead times are indicative: orders are delivered within 5 to 8 business days of confirmation, unless the Customer chooses a later delivery date or in the event of a delay or incident beyond our control at the carrier. Delivery consists of the transfer to the Customer of physical possession of the product; the transfer of the risks of loss and damage occurs only at that time (products travel at the Seller’s risk). On delivery, the Customer checks the condition of the parcel in the carrier’s presence; in the event of damage, they refuse the damaged product, noting "Refused for damage" on the delivery note, or make precise and reasoned reservations, failing which any recourse against the carrier may be lost (Art. L.133-3 of the French Commercial Code: reservations to be confirmed to the carrier within 3 days by registered letter). If the products have not been delivered within 30 days of order validation (except force majeure or the Customer’s own act), the Customer may, under Articles L.216-2 and L.216-3 of the French Consumer Code, order the Seller to deliver and then, failing that, rescind the sale; sums paid are then returned within 14 days at the latest.

8. Installation service (paid option)

For large appliances and televisions, home installation may be offered as a paid option, within the served area. It includes placing the product in the desired location and connecting it to installations that comply with the required standards (electrical, water supply and drainage). It is the Customer’s responsibility to assess the feasibility of delivery and placement (access, dimensions of doors, stairs, lift, access code) and to check built-in dimensions: the technicians do not carry out carpentry, plumbing or electrical work. Installation is reserved for domestic use, at the address given at the time of purchase.

9. Retention of title

The products remain the full and entire property of ASSEMAT ELECTROMENAGER until the price has been paid in full by the Customer, whatever the delivery date. An invoice is issued and given to the Customer on delivery.

10. Right of withdrawal

The Customer has 14 calendar days from receipt of the product (or the last parcel) to exercise their right of withdrawal, without reason or penalty, via the online withdrawal button (available even in guest mode), the standard withdrawal form, or any unambiguous letter/email sent to support@sweet-houses.com. After notification, the Customer has 14 days to return the product. Return costs remain at the Customer’s expense (small appliances: postal; large appliances: private carrier, maximum cost estimated at €40 to €90 incl. VAT for mainland France). The product must be returned complete (accessories, manuals), in a condition allowing resale, together with the invoice. In accordance with Article L.221-28 of the French Consumer Code, unsealed hygiene products and unsealed audio/video recordings or software, in particular, cannot be withdrawn. The refund (price + standard outbound delivery costs) is made within 14 days of notification at the latest, the Seller being able to defer it until the product is recovered or proof of its shipment is provided. 11. Legal and commercial warranties

All products benefit from the legal warranty of conformity (Articles L.217-1 to L.217-32 of the French Consumer Code): the Customer has 2 years from delivery to obtain the item’s conformity, defects appearing within this period being presumed to pre-date delivery. The warranty gives the right to repair or replacement within 30 days of the request, at no cost and without major inconvenience; a repaired item benefits from a 6-month extension of the initial warranty, a replaced item from a new 2-year warranty. The Customer may obtain a price reduction or rescission of the contract if the Seller refuses to repair or replace, if this occurs beyond 30 days or causes major inconvenience, or if the defect persists; rescission is not available for a minor defect. A Seller who wrongfully obstructs this warranty incurs a civil fine (Art. L.241-5). The Customer also benefits from the legal warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code) for 2 years from discovery of the defect. Some products additionally benefit from a manufacturer’s commercial warranty (duration and coverage shown on the product page), which is in addition to the legal warranties and does not replace them. 12. Take-back of used equipment (WEEE)

In accordance with the French AGEC law, ASSEMAT ELECTROMENAGER systematically offers, free of charge, the "one-for-one" take-back of the equivalent old appliance when purchasing a new appliance of the same type (small appliance: local collection point or prepaid label on request; large appliance: take-back at the delivery point, on an option ticked before ordering, with the appliance unplugged, drained and safely accessible). Used electrical and electronic equipment must not be thrown out with household waste.

13. Repairability / durability index

In accordance with Article L.541-9-2 of the French Environmental Code, the repairability or durability index (a score out of 10) is shown on the page of the appliances concerned (in particular washing machines, dishwashers, vacuum cleaners, televisions, etc.). The detailed calculation grids are available on the product page or on request.

14. Payment security

The site and payment are secured by SSL/TLS encryption. Payment is processed by the provider Shopify, which is PCI-DSS compliant: bank details (card number, expiry date, security code) are encrypted and neither pass through nor are stored on ASSEMAT ELECTROMENAGER’s servers.

15. Liability

The products offered comply with French legislation in force and the standards applicable in France. ASSEMAT ELECTROMENAGER cannot be held liable for non-performance of the contract in the event of force majeure (disruption or strike of postal and transport services, flooding, fire, etc.). As the products are intended for domestic use, the Seller cannot be held liable for damage resulting from professional use.

16. Personal data

The processing of personal data is described in the Privacy Policy. The Customer has rights of access, rectification, erasure, objection, portability and restriction, which they may exercise at contact@sweet-houses.com, as well as the right to lodge a complaint with the CNIL (French data protection authority).

17. Intellectual property

All the site’s content (text, visuals, trademarks, logos) is protected by intellectual property law. Any reproduction or use, in whole or in part, without prior written authorisation, is prohibited and may constitute infringement.

18. Governing law, disputes and mediation

These Terms are governed by French law. In the event of a dispute, the Customer is invited to contact after-sales support first (support@sweet-houses.com) to seek an amicable solution. In accordance with Articles L.612-1 et seq. of the French Consumer Code, the Customer may use a consumer mediator free of charge: AME CONSO (Association des Médiateurs Européens), 11 place Dauphine, 75001 Paris, website www.mediationconso-ame.com. They may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr. Failing an amicable solution, the competent courts will be seized under ordinary law.

19. Severability

If one of the clauses of these Terms were declared void or unwritten due to a change in legislation, regulation or a court decision, this would not affect the validity or application of the other clauses.
